This Copyright Infringement and Takedown Notification Policy (DMCA) describes the procedures that Koh Tao Diving Academy (hereinafter referred to as “the Company”) follows in response to notifications of alleged copyright infringement on its website kohtaodivingacademy.com and other related websites (hereinafter referred to as the “Website”).

1. Copyright Infringement Notification

The Company respects the intellectual property rights of third parties and takes copyright infringements very seriously. If a copyright holder believes that their work has been copied in a way that constitutes a copyright infringement and is found on the Website, the copyright holder or their authorized representative may send a copyright infringement notification to the Company, in accordance with the terms of the Digital Millennium Copyright Act (DMCA).

2. Affected Content

The copyright infringement notification must include the following information:

  • Identification of the copyrighted work claimed to have been infringed, or if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site.
  • Identification of the material claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit the Company to locate the material.
  • Reasonably sufficient information to enable the Company to contact the complaining party, such as an address, telephone number, and, if available, an email address at which the complaining party may be contacted.
  • A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

3. Response Procedure

Upon receipt of a valid copyright infringement notification, the Company will proceed to take appropriate action, which may include the removal or disabling of access to the allegedly infringing material. The Company may also notify the user who posted the allegedly infringing material and provide them with a copy of the copyright infringement notification.

4. Counter Notification

If a user receives a copyright infringement notification and believes in good faith that the material has been removed by mistake or that the user has the right to post the material, the user may send a counter notification to the Company. The counter notification must include the following information:

  • Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.
  • A statement under penalty of perjury that the user has a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material.
  • The user’s name, address, telephone number, and email address, and a statement that the user consents to the jurisdiction of the federal district court for the judicial district in which the user’s address is located, or if the user’s address is outside of the United States, to any federal district court in which the Company may be found, and that the user will accept service of process from the person who provided the copyright infringement notification or their agent.
